Website Terms of Use

Version 1.0

FISCAL Technologies Limited – Website Terms of Use

Version 1.0

1. Introduction and acceptance

1.1 This page sets out the terms on which you may use fiscaltec.com (the “site”). By accessing or using the site, you agree to these terms. If you do not agree to these terms, you must not use the site.

1.2 The site is operated by FISCAL Technologies Ltd, a company registered in England and Wales under company number 4801836, with its registered office at 448 Basingstoke Road, Reading, Berkshire RG2 0LP, United Kingdom. References to “FISCAL”, “we”, “us”, and “our” are to FISCAL Technologies Ltd.

1.3 These terms govern your use of the publicly accessible parts of the site only. If you are a customer of FISCAL, your use of our software and services is governed by a separate agreement between you (or your organisation) and FISCAL. Where there is any conflict between these terms and that separate agreement in relation to the software and services, that separate agreement will prevail.

1.4 These terms should be read together with our Privacy Policy and our Cookie Notice, which together with these terms govern your use of the site.

2. Changes to these terms

2.1 We may update these terms from time to time to reflect changes to the site, our business, or applicable law. The version in force is the version published on this page at the time you access the site.

2.2 We recommend that you review these terms periodically. Continued use of the site after changes are published constitutes acceptance of the updated terms.

3. Accessing the site

3.1 Access to the site is provided on an “as available” basis. We may suspend, withdraw, or restrict the availability of all or any part of the site for business or operational reasons, and we will not be liable to you if for any reason the site is unavailable at any time or for any period.

3.2 The content of the site is subject to change without notice.

3.3 You are responsible for making all arrangements necessary for you to have access to the site, including your own equipment, internet connection, and security arrangements. You are also responsible for ensuring that all persons who access the site through your internet connection are aware of these terms and comply with them.

4. Intellectual property, use of content, and linking

4.1 Ownership of content

4.1.1 All content on the site, including text, graphics, logos, images, video, audio, downloadable documents, reports, guides, and the design and arrangement of the site itself, is owned by FISCAL or its licensors and is protected by copyright, trade mark, database right, and other intellectual property laws.

4.2 Permitted use

You may, for your personal reference or for the internal business purposes of your organisation:

(a) view content on the site on any device;

(b) download or print one or more copies of any content; and

(c) share links to pages on the site through normal means (including by email and on professional networks).

4.3 Restrictions

You must not, without our prior written permission:

(a) republish, redistribute, resell, sublicense, or otherwise make any content available to third parties outside your organisation;

(b) use any content for commercial purposes, including in any product, service, training programme, or publication offered to third parties;

(c) modify, adapt, translate, or create derivative works from any content; or

(d) remove or alter any copyright, trade mark, or other proprietary notices on the site or in any content.

4.3.1 Where we permit you to share or quote content, you must include a clear attribution to FISCAL Technologies and, where practical, a link to the source page on the site. Nothing in these terms grants you any right or licence in any FISCAL trade mark or brand asset, except as expressly set out in clause 4.2.

4.4 Third-party trade marks

4.4.1 Trade marks, logos, and brand names of third parties that appear on the site (including customer, partner, and analyst marks) are the property of their respective owners and are used for identification and reference purposes only. Their appearance on the site does not imply any endorsement, sponsorship, or affiliation unless expressly stated.

4.5 Links to the site

4.5.1 You may link to pages on the site, provided that you do so in a way that is fair and legal, does not damage our reputation or take advantage of it, and does not suggest any form of association, approval, or endorsement on our part where none exists.

4.5.2 You must not frame the site or any of its pages on any other website, and our pages must load in the user’s full browser window.

4.5.3 We reserve the right to withdraw linking permission at any time, and you must remove any link to the site if we ask you to.

4.6 Links from the site

4.6.1 The site may contain links to websites, content, or services operated by third parties (including analyst reports, partner websites, press coverage, and social-media platforms). These links are provided for your convenience and information only.

4.6.2 We do not control, monitor, or endorse the content of those third-party sites, and we are not responsible for their availability, content, accuracy, or any goods or services obtained through them. Your use of any third-party site is at your own risk and is subject to the terms and policies of that site.

5. Acceptable use

5.1 When you use the site, you must not:

(a) use the site in any way that breaches any applicable law or regulation, or that is fraudulent or has any fraudulent purpose or effect;

(b) attempt to gain unauthorised access to the site, the server on which the site is hosted, or any server, computer, or database connected to the site;

(c) introduce or attempt to introduce any virus, trojan, worm, logic bomb, or other material that is malicious or technologically harmful;

(d) attack the site through a denial-of-service attack, a distributed denial-of-service attack, or any similar means;

(e) submit false, misleading, or impersonating information through any form on the site, or use automated means (including bots, scripts, or form-fillers) to submit forms, create accounts, or interact with the site; or

(f) interfere with, disrupt, or place an unreasonable load on the site or any related infrastructure.

5.2 Automated access. Except as expressly permitted in clause 5.3, you must not use any automated system to access, copy, or extract content from the site, including by way of scraping, crawling, harvesting, or any equivalent technique.

5.3 We do permit:

(a) access by recognised search-engine and AI-assistant crawlers operating in good faith and in accordance with the directives published in our robots.txt and llms.txt files; and

(b) access by automated tools that you operate solely for your own internal monitoring or accessibility-testing purposes, provided this does not place an unreasonable load on the site.

5.4 AI training and bulk extraction. Content on the site may be accessed and ingested by AI systems for the purposes of indexing, retrieval, and answering user queries, where attribution is preserved. However, you must not, and you must not permit any third party to, extract, scrape, copy, or otherwise reproduce content from the site in bulk for the purpose of training, fine-tuning, or otherwise developing any machine-learning model, large language model, or similar system, without our prior written permission.

5.5 Breach of this clause 5 may result in your access to the site being blocked, the matter being reported to the relevant authorities, and the pursuit of legal remedies. Unauthorised use of the site may give rise to a claim for damages and may also constitute a criminal offence under the Computer Misuse Act 1990 or other applicable law.

6. User submissions and feedback

6.1 From time to time you may submit information to us through the site, for example by completing a contact form, registering for a webinar, downloading a gated resource, or sending us feedback. The way we handle personal data submitted through the site is set out in our Privacy Policy, which forms part of these terms.

6.2 Subject to the Privacy Policy, any other information you submit through the site (including suggestions, comments, ideas, questions, and other materials) is provided on a non-confidential and non-proprietary basis. You agree that we may use such information for any reasonable business purpose, including to improve the site, our products, and our services, and for marketing and product-development purposes, without obligation, attribution, or compensation to you.

6.3 In particular, where you provide us with feedback, suggestions, or ideas relating to the site, our products, or our services, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, adapt, and incorporate that feedback in any way we see fit, with no obligation to credit or compensate you.

6.4 You must not submit any content to the site that is unlawful, defamatory, infringing of any third-party rights, confidential to a third party, or otherwise inappropriate. You are responsible for the accuracy and lawfulness of any information you submit, and you confirm that you have all necessary rights to submit it.

7. Disclaimers

7.1 The content on the site is provided for general information purposes only. While we make reasonable efforts to keep the content up to date and accurate, we make no representations or warranties of any kind, whether express or implied, about the completeness, accuracy, reliability, suitability, or availability of the site or any content on it. Any reliance you place on such content is strictly at your own risk.

7.2 To the fullest extent permitted by law, we exclude all conditions, warranties, representations, and other terms which might otherwise be implied by statute, common law, or the law of equity.

8. Audience and limitation of liability

8.1 The site is intended for use by businesses and by individuals acting in the course of their business, profession, or trade. It is not intended for use by consumers (as defined in the Consumer Rights Act 2015). If you are a consumer, you should not rely on these terms or on any content on the site, and we ask that you do not use the site.

8.2 Subject to clause 8.3, and to the fullest extent permitted by law:

(a) we exclude all liability arising out of or in connection with your use of, or inability to use, the site or any content on it, whether in contract, tort (including negligence), breach of statutory duty, or otherwise;

(b) in particular, we will not be liable for any loss of profits, loss of business, loss of revenue, loss of anticipated savings, loss of goodwill, loss of or damage to data, or any indirect or consequential loss.

8.3 Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability which cannot lawfully be excluded or limited.

9. Indemnity

9.1 You agree to indemnify, defend, and hold harmless FISCAL, its officers, directors, employees, agents, and affiliates from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

(a) your breach of these terms;

(b) your misuse of the site or any content; or

(c) your infringement of any third-party right (including any intellectual property right) in connection with your use of the site.

10. General

10.1 Events beyond our control. We will not be liable for any failure to comply with these terms, or any delay in doing so, where the failure or delay is caused by circumstances beyond our reasonable control (including, without limitation, internet or telecommunications failures, denial-of-service attacks, hosting or infrastructure failures, acts of government, or natural events).

10.2 Severability. If any provision of these terms is found by a court or other competent authority to be unlawful, void, or unenforceable, that provision will be deemed severed from the remaining provisions, which will continue in full force and effect.

10.3 No waiver. Our failure to enforce any provision of these terms at any time will not be construed as a waiver of that provision or of our right to enforce it later. Any waiver of any provision will only be effective if given in writing and signed by us.

10.4 Entire agreement (website only). These terms set out the entire agreement between you and us in relation to your use of the site and supersede any prior statements, representations, or understandings about your use of the site. For the avoidance of doubt, this clause does not affect, vary, or override the terms of any separate agreement between you (or your organisation) and FISCAL relating to FISCAL’s software or services, which remain in full force and effect.

10.5 No third-party rights. A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them.

11. Governing law and jurisdiction

11.1 These terms, their subject matter, and their formation, are governed by the laws of England and Wales.

11.2 You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms or your use of the site.
